Zem\u011b, kter\u00e1 ovl\u00e1dne trh s biotechnologiemi, ur\u010d\u00ed, jak\u00e1 pravidla a normy budeme pro tyto technologie pou\u017e\u00edvat. \u010c\u00ednsk\u00e1 lidov\u00e1 republika (\u010cLR) se od roku 2016 na biotechnologie zam\u011b\u0159uje a chce se st\u00e1t biotechnologickou supervelmoc\u00ed. K roz\u0161\u00ed\u0159en\u00ed kapacit v oblasti genomick\u00e9ho sekvenov\u00e1n\u00ed hojn\u011b vyu\u017e\u00edv\u00e1 st\u00e1tn\u00ed podporu. Z\u00e1rove\u0148 shroma\u017e\u010fuje genomick\u00e1 data z cel\u00e9ho sv\u011bta. \u010c\u00ednsk\u00e1 strategie vojensk\u00e9 a civiln\u00ed f\u00faze a jej\u00ed vyu\u017eit\u00ed biotechnologi\u00ed pro n\u00e1rodn\u00ed zpravodajsk\u00e9 slu\u017eby p\u0159in\u00e1\u0161\u00ed riziko, \u017ee data a kapit\u00e1l z demokratick\u00fdch zem\u00ed pomohou \u010c\u00edn\u011b vyv\u00edjet biotechnologie s vojensk\u00fdm vyu\u017eit\u00edm. Demokratick\u00e9 st\u00e1ty mus\u00ed urychlen\u011b jednat a \u0159e\u0161it \u010d\u00ednsk\u00e9 netr\u017en\u00ed praktiky, pos\u00edlit ochranu genomick\u00fdch dat a zabr\u00e1nit tomu, aby jejich ve\u0159ejn\u00e9 prost\u0159edky napom\u00e1haly r\u016fstu biotechnologick\u00fdch spole\u010dnost\u00ed v \u010cLR.<\/p>\n\n\n\n<p><strong>Kl\u00ed\u010dov\u00e1 slova:&nbsp;<\/strong>biotechnologie; BGI; genomika; technologick\u00e1 sout\u011b\u017e; USA-\u010c\u00edna<\/p>\n\n\n\n<p><strong>\u00davod<\/strong><\/p>\n\n\n\n<p>Ve sv\u00e9m \u00favodn\u00edm projevu na zased\u00e1n\u00ed V\u00fdboru pro \u010c\u00ednu pozvedl \u010dlen v\u00fdboru Raja Krishnamoorti velk\u00fd plak\u00e1t Kapit\u00e1na Ameriky a \u0159ekl, \u017ee \u010c\u00edna vyv\u00edj\u00ed \u201esupervoj\u00e1ky\u201c (Select Committee on the Chinese Communist Party 2024). Je snadn\u00e9 kritizovat politiku USA v\u016f\u010di \u010c\u00edn\u011b a ozna\u010dit ji za alarmistickou. Um\u011bl\u00e1 inteligence se ale vyv\u00edj\u00ed tak rychle, \u017ee v kombinaci s hlub\u0161\u00edm pochopen\u00edm lidsk\u00e9ho genomu se v\u00fdvoj biotechnologi\u00ed pro vojensk\u00e9 \u00fa\u010dely (\u0159\u00edkejme tomu z nedostatku vhodn\u011bj\u0161\u00edho v\u00fdrazu&nbsp; \u201esupervoj\u00e1ci\u201c) nezd\u00e1 nemo\u017en\u00fd.<\/p>\n\n\n\n<p>Biotechnologie se v sou\u010dasnosti nach\u00e1zej\u00ed na prahu z\u00e1sadn\u00edho zlomu, kdy nejnov\u011bj\u0161\u00ed pokroky v oblasti um\u011bl\u00e9 inteligence vytv\u00e1\u0159ej\u00ed podm\u00ednky pro jejich rychl\u00fd rozvoj a z\u00e1rove\u0148 roz\u0161i\u0159uj\u00ed mo\u017enosti jejich ekonomick\u00e9ho i vojensk\u00e9ho vyu\u017eit\u00ed. St\u00e1vaj\u00ed se tak nov\u00fdm boji\u0161t\u011bm technologick\u00e9 rivality mezi Spojen\u00fdmi st\u00e1ty a \u010c\u00ednou, \u00fast\u0159edn\u00edm bodem eskaluj\u00edc\u00ed obchodn\u00ed v\u00e1lky (MOFCOM 2025) a kl\u00ed\u010dov\u00fdm p\u0159edm\u011btem z\u00e1jmu v oblasti n\u00e1rodn\u00ed bezpe\u010dnosti (National Counterintelligence and Security Center 2021).<\/p>\n\n\n\n<p>Nejde v\u0161ak pouze o hospod\u00e1\u0159sk\u00e9 a mocensk\u00e9 soupe\u0159en\u00ed. Biotechnologie zasahuj\u00ed do samotn\u00fdch z\u00e1klad\u016f \u017eivota a jejich vyu\u017e\u00edv\u00e1n\u00ed s sebou nese z\u00e1sadn\u00ed etick\u00e9 a mor\u00e1ln\u00ed ot\u00e1zky. St\u00e1t \u010di st\u00e1ty, kter\u00e9 v tomto technologick\u00e9m z\u00e1vod\u011b z\u00edskaj\u00ed p\u0159evahu, budou m\u00edt z\u00e1sadn\u00ed vliv na formov\u00e1n\u00ed pravidel a norem, jimi\u017e se budouc\u00ed pou\u017e\u00edv\u00e1n\u00ed t\u011bchto technologi\u00ed bude \u0159\u00eddit.<\/p>\n\n\n\n<p>\u010c\u00edna usiluje o to st\u00e1t se \u201ebiotechnologickou velmoc\u00ed\u201d (\u751f\u7269\u6280\u672f\u5f3a\u56fd) (Ministry of Science and Tecnology of the People\u2019s Republic of China 2017) &nbsp;p\u0159i\u010dem\u017e n\u011bkter\u00e9 z pou\u017e\u00edvan\u00fdch metod vyvol\u00e1vaj\u00ed zna\u010dn\u00e9 znepokojen\u00ed. Mezi n\u011b pat\u0159\u00ed nap\u0159\u00edklad vynucen\u00fd sb\u011br genetick\u00fdch dat od p\u0159\u00edslu\u0161n\u00edk\u016f utla\u010dovan\u00fdch etnick\u00fdch men\u0161in v \u010c\u00edn\u011b (Hawkins 2023) \u010di shroma\u017e\u010fov\u00e1n\u00ed genetick\u00fdch informac\u00ed od nic netu\u0161\u00edc\u00edch t\u011bhotn\u00fdch \u017een po cel\u00e9m sv\u011bt\u011b (Needham a Baldwin 2021). Zvl\u00e1\u0161\u0165 alarmuj\u00edc\u00ed je, \u017ee n\u011bkte\u0159\u00ed \u010d\u00edn\u0161t\u00ed vojen\u0161t\u00ed strat\u00e9gov\u00e9 zva\u017euj\u00ed potenci\u00e1l tzv. \u201eetnicky specifick\u00fdch genetick\u00fdch \u00fatok\u016f\u201c (Kania a VornDick 2019).<\/p>\n\n\n\n<p>\u010c\u00edna na poli biotechnologi\u00ed usiluje o to, aby prohloubila strategickou z\u00e1vislost konkurent\u016f a z\u00edskala nov\u00e9 mo\u017enosti ekonomick\u00e9ho n\u00e1tlaku. Ji\u017e dnes dominuje v\u00fdrob\u011b farmaceutick\u00fdch p\u0159\u00edsad (U.S.-China Economic and Security Review Commission 2019) a zajistila si celosv\u011btov\u00e9 dod\u00e1vky prim\u00e1t\u016f, kte\u0159\u00ed jsou nezbytn\u00ed pro schv\u00e1len\u00ed jak\u00e9hokoli nov\u00e9ho l\u00e9ku ke komer\u010dn\u00edmu pou\u017eit\u00ed (National Association for Biomedical Research 2021; Boggan 2021). Peking u\u010dinil z genomiky n\u00e1rodn\u00ed prioritu a pova\u017euje genetick\u00e1 data za hnac\u00ed s\u00edlu pro v\u00fdvoj nov\u00fdch biotechnologick\u00fdch aplikac\u00ed, podobn\u011b jako jsou data hnac\u00ed silou pro v\u00fdvoj syst\u00e9m\u016f um\u011bl\u00e9 inteligence. Vybudoval nejv\u011bt\u0161\u00ed \u00falo\u017ei\u0161t\u011b genetick\u00fdch dat na sv\u011bt\u011b a pos\u00edlil mezin\u00e1rodn\u00ed zapojen\u00ed sv\u00fdch p\u0159edn\u00edm obchodn\u00edch spole\u010dnost\u00ed s c\u00edlem shroma\u017e\u010fovat nebo z\u00edsk\u00e1vat zahrani\u010dn\u00ed data (Puglisi a Rask 2024).<\/p>\n\n\n\n<p>Demokratick\u00e9 st\u00e1ty si nemohou dovolit tuto technologickou sout\u011b\u017e prohr\u00e1t. Vzhledem k tomu, \u017ee \u010d\u00ednsk\u00e1 vl\u00e1da se ne\u0159\u00edd\u00ed hodnotami osobn\u00ed svobody, individu\u00e1ln\u00edch pr\u00e1v ani lidsk\u00e9 d\u016fstojnosti, nelze o\u010dek\u00e1vat, \u017ee se p\u0159i vyu\u017e\u00edv\u00e1n\u00ed biotechnologi\u00ed bude omezovat liber\u00e1ln\u00edmi normami. Demokratick\u00e9 zem\u011b proto mus\u00ed v\u00fdrazn\u011b urychlit rozvoj vlastn\u00edho biotechnologick\u00e9ho sektoru a z\u00e1rove\u0148 aktivn\u011b \u010delit snah\u00e1m \u010cLR o glob\u00e1ln\u00ed dominanci v t\u00e9to oblasti.<\/p>\n\n\n\n<p>Zvl\u00e1\u0161tn\u00ed pozornost by m\u011bla b\u00fdt v\u011bnov\u00e1na genomice, kter\u00e1 p\u0159edstavuje kl\u00ed\u010dov\u00fd vstupn\u00ed bod a z\u00e1rove\u0148 potenci\u00e1ln\u00ed \u00fazk\u00e9 hrdlo biotechnologick\u00e9ho pokroku. Je nezbytn\u00e9 soust\u0159edit \u00fasil\u00ed pr\u00e1v\u011b na tuto oblast je\u0161t\u011b d\u0159\u00edve, ne\u017e si \u010d\u00ednsk\u00e9 spole\u010dnosti upevn\u00ed sv\u00e9 postaven\u00ed na glob\u00e1ln\u00edm trhu do t\u00e9 m\u00edry, \u017ee jej ji\u017e nebude mo\u017en\u00e9 efektivn\u011b zpochybnit (Puglisi a Rask 2024).<\/p>\n\n\n\n<p>Vl\u00e1da Spojen\u00fdch st\u00e1t\u016f ji\u017e podnikla z\u00e1sadn\u00ed kroky na podporu dom\u00e1c\u00edho biotechnologick\u00e9ho sektoru (Office of Science and Technology Policy 2024) a sou\u010dasn\u011b omezila p\u0159\u00edstup k americk\u00fdm technologi\u00edm spole\u010dnostem se s\u00eddlem v&nbsp;\u010cLR, p\u0159\u00edpadn\u011b v \u010d\u00ednsk\u00e9m vlastnictv\u00ed (Bureau of Industry and Security 2023). Navrhla dal\u0161\u00ed opat\u0159en\u00ed, kter\u00e1 by m\u011bla omezit p\u016fsoben\u00ed \u010d\u00ednsk\u00fdch firem na \u00fazem\u00ed Spojen\u00fdch st\u00e1t\u016f, v\u010detn\u011b jejich p\u0159\u00edstupu k ve\u0159ejn\u00fdm finan\u010dn\u00edm zdroj\u016fm (H.R. 8333 2024) a genetick\u00fdm \u00fadaj\u016fm americk\u00fdch ob\u010dan\u016f&nbsp; (U.S. Congress. Senate, 2023). &nbsp;Spojen\u00e9 st\u00e1ty nav\u00edc v\u00fdslovn\u011b identifikovaly v\u00fdvoj biotechnologi\u00ed v \u010c\u00edn\u011b jako potenci\u00e1ln\u00ed hrozbu pro americkou n\u00e1rodn\u00ed bezpe\u010dnost a podnikaj\u00ed konkr\u00e9tn\u00ed kroky k urychlen\u00ed v\u00fdvoje a integrace biotechnologi\u00ed do syst\u00e9mu n\u00e1rodn\u00ed obrany (National Security Commission on Emerging Biotechnology 2024; National Counterintelligence and Security Center 2021).<\/p>\n\n\n\n<p>Navzdory zdokumentovan\u00fdm p\u0159\u00edpad\u016fm shroma\u017e\u010fov\u00e1n\u00ed genetick\u00fdch \u00fadaj\u016f od t\u011bhotn\u00fdch \u017een (Needham a Baldwin 2021), sekvenov\u00e1n\u00ed genomu obyvatelstva Ma\u010farska (BGI Genomics 2022) &nbsp;\u010di rozs\u00e1hl\u00e9ho poskytov\u00e1n\u00ed evropsk\u00fdch genetick\u00fdch dat spole\u010dnostem, u nich\u017e je dolo\u017eena spolupr\u00e1ce s&nbsp;\u010d\u00ednskou Lidovou osvobozeneckou arm\u00e1dou (LOA) (Cheung, Hope, a Mattis 2024), z\u016fst\u00e1v\u00e1 evropsk\u00e1 diskuse prim\u00e1rn\u011b zam\u011b\u0159ena na ekonomick\u00e9 ot\u00e1zky (European Commission 2024a). \u0158e\u0161en\u00ed bezpe\u010dnostn\u00edch hrozeb \u010dasto nar\u00e1\u017e\u00ed na administrativn\u00ed bari\u00e9ry a nedostatek politick\u00e9 koordinace.<\/p>\n\n\n\n<p>Evropsk\u00e1 unie mus\u00ed urychlit svou pr\u016fmyslovou politiku a aktivn\u011bji reagovat na \u010d\u00ednsk\u00e9 netr\u017en\u00ed praktiky, zejm\u00e9na pokud jde o sb\u011br genetick\u00fdch dat ob\u010dan\u016f EU. K tomu bude zapot\u0159eb\u00ed koordinovan\u00e9 \u00fasil\u00ed na \u00farovni EU i jednotliv\u00fdch \u010dlensk\u00fdch st\u00e1t\u016f.<\/p>\n\n\n\n<p><strong>Co jsou biotechnologie<\/strong><\/p>\n\n\n\n<p>A\u010dkoli jsou biotechnologie \u010dasto vn\u00edm\u00e1ny jako vysoce modern\u00ed obor, jejich z\u00e1klady sahaj\u00ed tis\u00edce let do minulosti \u2013 p\u0159\u00edkladem m\u016f\u017ee b\u00fdt tradi\u010dn\u00ed v\u00fdroba piva. Co je v\u0161ak nov\u00e9ho, je m\u00edra, v jak\u00e9 dnes dok\u00e1\u017eeme biologick\u00e9 procesy nejen ovliv\u0148ovat, ale tak\u00e9 je navrhovat a vytv\u00e1\u0159et, a to v \u0161irok\u00e9 \u0161k\u00e1le aplikac\u00ed od zdravotnictv\u00ed a\u017e po oblast obrany. St\u0159edobodem sou\u010dasn\u00e9ho v\u00fdzkumu je genomika \u2013 studium struktury, funkce a exprese gen\u016f. Podobn\u011b jako v\u00fdvoj um\u011bl\u00e9 inteligence je i genomick\u00fd v\u00fdzkum siln\u011b z\u00e1visl\u00fd na p\u0159\u00edstupu k rozs\u00e1hl\u00fdm datov\u00fdm soubor\u016fm. Sb\u011br a anal\u00fdza genetick\u00fdch informac\u00ed umo\u017e\u0148uj\u00ed pr\u016flomov\u00e9 objevy v oblasti personalizovan\u00e9 medic\u00edny i biologick\u00e9 bezpe\u010dnosti. Pr\u00e1v\u011b propojen\u00ed um\u011bl\u00e9 inteligence a biotechnologi\u00ed (tzv. AIxBIO) v\u00fdznamn\u011b urychluje v\u00fdvoj v t\u011bchto oblastech a \u010din\u00ed z genomiky strategickou dom\u00e9nu mezin\u00e1rodn\u00ed konkurence s v\u00fdznamn\u00fdmi dopady na ekonomiku, zdravotnictv\u00ed i n\u00e1rodn\u00ed bezpe\u010dnost.<\/p>\n\n\n\n<p>Genomika p\u0159edstavuje kl\u00ed\u010dovou oblast biotechnologi\u00ed, proto\u017ee v\u011bdc\u016fm umo\u017e\u0148uje de\u0161ifrovat z\u00e1kladn\u00ed stavebn\u00ed kameny \u017eivota. Tato schopnost otev\u00edr\u00e1 prostor pro inovace v medic\u00edn\u011b, zem\u011bd\u011blstv\u00ed i syntetick\u00e9 biologii. St\u0159edobodem genomiky je genetick\u00e9 sekvenov\u00e1n\u00ed \u2013 proces, jeho\u017e c\u00edlem je p\u0159e\u010d\u00edst strukturu DNA nebo RNA a z\u00edskat tak poznatky o fungov\u00e1n\u00ed, v\u00fdvoji a interakci gen\u016f s prost\u0159ed\u00edm. Genetick\u00e9 sekvenov\u00e1n\u00ed slou\u017e\u00ed jako vstupn\u00ed br\u00e1na k z\u00e1sadn\u00edm v\u011bdeck\u00fdm objev\u016fm \u2013 od identifikace genetick\u00fdch marker\u016f pro v\u010dasnou diagnostiku onemocn\u011bn\u00ed a\u017e po in\u017een\u00fdrsk\u00e9 \u00fapravy mikroorganism\u016f pro \u00fa\u010dely produkce biopaliv. D\u00edky t\u011bmto aplikac\u00edm m\u00e1 genomika z\u00e1sadn\u00ed v\u00fdznam pro v\u00fdvoj technologi\u00ed, kter\u00e9 mohou transformovat cel\u00e9 pr\u016fmyslov\u00e9 sektory i syst\u00e9my zdravotn\u00ed p\u00e9\u010de.<\/p>\n\n\n\n<p><strong>\u010c\u00ednsk\u00e9 biotechnologick\u00e9 ambice a strategie<\/strong><\/p>\n\n\n\n<p>N\u011bkte\u0159\u00ed p\u0159edstavitel\u00e9 \u010c\u00ednsk\u00e9 komunistick\u00e9 strany se domn\u00edvaj\u00ed, \u017ee dominance biotechnologick\u00e9ho pr\u016fmyslu vydl\u00e1\u017ed\u00ed \u010cLR cestu k p\u0159evaze ve 21.<sup>.<\/sup>stolet\u00ed: \u201eTak jako Evropa z\u00edskala v 19. stolet\u00ed p\u0159evahu d\u00edky pr\u016fmyslu a Spojen\u00e9 st\u00e1ty&nbsp; ve 20. stolet\u00ed d\u00edky informa\u010dn\u00edch technologi\u00edm, tak \u010c\u00edna ve 21. stolet\u00ed zv\u00edt\u011bz\u00ed d\u00edky biologii\u201c (Carlson a Wehbring 2020). \u010c\u00edna se t\u00e9to p\u0159\u00edle\u017eitosti chopila v roce 2016, kdy za\u0159adila rozvoj biotechnologi\u00ed do sv\u00e9 13. p\u011btiletky (State Council of the People\u2019s Republic of China 2016).&nbsp;<strong>&nbsp;<\/strong>Peking se zam\u011b\u0159il na oblast genomiky, konkr\u00e9tn\u011b na studium zp\u016fsobu k\u00f3dov\u00e1n\u00ed a exprese gen\u016f. St\u00e1t, kter\u00fd v oblasti genomiky z\u00edsk\u00e1 dominantn\u00ed postaven\u00ed, bude schopen \u201e\u0159\u00eddit v\u00fdvoj l\u00e9ka\u0159sk\u00fdch technologi\u00ed nov\u00e9 generace, ur\u010dovat standardy a normy v\u00fdzkumu a budouc\u00ed vyu\u017eit\u00ed genomiky\u201c (Puglisi a Rask 2024).<\/p>\n\n\n\n<p>S c\u00edlem uspokojit pot\u0159eby sv\u00fdch datov\u011b n\u00e1ro\u010dn\u00fdch projekt\u016f \u010cLR v\u00fdrazn\u011b roz\u0161\u00ed\u0159ila n\u00e1rodn\u00ed kapacity v oblasti technologi\u00ed a slu\u017eeb genetick\u00e9ho sekvenov\u00e1n\u00ed (Schuerger a Puglisi 2024). V\u00fdznamnou roli v tomto \u00fasil\u00ed sehr\u00e1l rozvoj Pekingsk\u00e9ho genomick\u00e9ho institutu (<em>Beijing Genomics Institute<\/em>, BGI), jeho\u017e mezin\u00e1rodn\u00ed expanze v posledn\u00edch letech v\u00fdrazn\u011b akcelerovala (Puglisi a Rask 2024; BGI Genomics 2024a). Podle dostupn\u00fdch \u00fadaj\u016f je BGI \u201ep\u0159edn\u00edm sv\u011btov\u00fdm poskytovatelem integrovan\u00fdch \u0159e\u0161en\u00ed v oblasti precizn\u00ed medic\u00edny\u201c, kter\u00fd aktu\u00e1ln\u011b nab\u00edz\u00ed sv\u00e9 slu\u017eby ve v\u00edce ne\u017e 100 zem\u00edch a spolupracuje s v\u00edce ne\u017e 2 300 zdravotnick\u00fdmi za\u0159\u00edzen\u00edmi (BGI Genomics 2025a). Trajektorie r\u016fstu skupiny BGI vykazuje podobnosti s v\u00fdvojem spole\u010dnosti Huawei \u2013 v obou p\u0159\u00edpadech sehr\u00e1la kl\u00ed\u010dovou roli masivn\u00ed st\u00e1tn\u00ed podpora, je\u017e umo\u017enila nejprve konsolidaci dom\u00e1c\u00edho trhu a n\u00e1sledn\u011b expanzi na glob\u00e1ln\u00ed \u00farove\u0148 (Puglisi a Rask 2024).<\/p>\n\n\n\n<p>Zat\u00edmco p\u0159\u00edjmy z mezin\u00e1rodn\u00edch operac\u00ed BGI st\u00e1le tvo\u0159\u00ed pouze malou \u010d\u00e1st celkov\u00e9ho obratu a na trhu nad\u00e1le p\u016fsob\u00ed konkurenceschopn\u00e9 americk\u00e9 a evropsk\u00e9 spole\u010dnosti, vysok\u00e1 m\u00edra st\u00e1tn\u00ed podpory p\u0159edstavuje riziko. Biotechnologie jsou prim\u00e1rn\u011b vn\u00edm\u00e1ny jako p\u0159\u00edle\u017eitost, jak sn\u00ed\u017eit z\u00e1vislost EU na fosiln\u00edch palivech, a jako cesta k&nbsp;produkci obnoviteln\u00fdch zdroj\u016f (European Commission 2024e). EU v\u00ed, \u017ee pro \u010cRL jsou biotechnologie&nbsp; prioritou, ale zat\u00edm nep\u0159ijala \u017e\u00e1dn\u00e1 p\u0159\u00edm\u00e1 opat\u0159en\u00ed, kter\u00e1 by br\u00e1nila \u010d\u00ednsk\u00e9 vl\u00e1d\u011b v tom, aby si uzurpovala rozvoj biotechnologi\u00ed t\u00edm, \u017ee podkope mezin\u00e1rodn\u00ed konkurenci v oblasti genetick\u00e9ho sekvenov\u00e1n\u00ed. Stejn\u011b tak z\u016fst\u00e1v\u00e1 omezen\u00e1 i evropsk\u00e1 reakce na rizika spojen\u00e1 se shroma\u017e\u010fov\u00e1n\u00edm genomick\u00fdch dat ob\u010dan\u016f EU. Evropsk\u00e1 unie nicm\u00e9n\u011b nezaost\u00e1v\u00e1 ve snaze propagovat biotechnologie jako hnac\u00ed motor ekonomick\u00e9ho r\u016fstu. V r\u00e1mci sv\u00e9 strategie technologick\u00e9 suverenity ozna\u010dila biotechnologie za jednu z deseti kritick\u00fdch technologi\u00ed nezbytn\u00fdch pro zaji\u0161t\u011bn\u00ed ekonomick\u00e9 bezpe\u010dnosti EU (European Commission 2023b; 2023a). Tyto po\u017eadavky tvo\u0159\u00ed z\u00e1klad pro vznik potencion\u00e1ln\u00edho evropsk\u00e9ho biotechnologick\u00e9ho z\u00e1kona v&nbsp;budoucnosti (European Commission 2024d).<\/p>\n\n\n\n<p>Evropsk\u00e1 unie a jej\u00ed \u010dlensk\u00e9 zem\u011b maj\u00ed k dispozici n\u011bkolik ekonomick\u00fdch n\u00e1stroj\u016f, ale ani jeden z nich nebyl pou\u017eit k tomu, aby zabr\u00e1nil \u010c\u00edn\u011b v nadvl\u00e1d\u011b nad kritick\u00fdmi oblastmi biotechnologi\u00ed. Abychom EU nek\u0159ivdili, mus\u00edme zm\u00ednit, \u017ee zah\u00e1jila vy\u0161et\u0159ov\u00e1n\u00ed hned n\u011bkolika netr\u017en\u00edch praktik a n\u00e1sledn\u011b uplatnila protiopat\u0159en\u00ed. To jsme mohli zaznamenat v oblasti elektrick\u00fdch vozidel (European Commission 2024b), elektrokol (European Commission 2025c), l\u00e9ka\u0159sk\u00e9ho za\u0159\u00edzen\u00ed (European Commission 2025b), biodieselu (European Commission 2025a) a n\u011bkolika dal\u0161\u00edch. Evropsk\u00e1 strategie hospod\u00e1\u0159sk\u00e9 bezpe\u010dnosti vyzdvihuje v\u00fdznam takzvan\u00e9ho protin\u00e1tlakov\u00e9ho n\u00e1stroje (<em>Anti-Coertion Instrument<\/em>), kter\u00fd by m\u011bl b\u00fdt aplikov\u00e1n v boji proti ekonomick\u00e9mu n\u00e1tlaku, jen\u017e by mohl vzniknout v d\u016fsledku strategick\u00e9 z\u00e1vislosti na \u010d\u00ednsk\u00fdch biotechnologi\u00edch (European Council 2023).<\/p>\n\n\n\n<p>Mechanismus kontroly zahrani\u010dn\u00edch investic (<em>Foreign Investment Screening<\/em>), kter\u00fd prozat\u00edm chr\u00e1n\u00ed jen osobn\u00ed \u00fadaje (Official Journal of the European Union L 79\/1 2019), bude v&nbsp;r\u00e1mci prob\u00edhaj\u00edc\u00ed revize pravd\u011bpodobn\u011b roz\u0161\u00ed\u0159en i na biotechnologie (European Parliament 2025). Kontrola p\u0159\u00edm\u00fdch zahrani\u010dn\u00edch investic se dot\u00fdk\u00e1 i ot\u00e1zek, kter\u00e9 vyvst\u00e1vaj\u00ed v&nbsp;souvislosti s aktivitami subjekt\u016f se s\u00eddlem v&nbsp;\u010c\u00edn\u011b, nebo\u0165 posuzuje, \u201ezda je dan\u00fd zahrani\u010dn\u00ed investor p\u0159\u00edmo \u010di nep\u0159\u00edmo ovl\u00e1d\u00e1n vl\u00e1dou t\u0159et\u00ed zem\u011b, v\u010detn\u011b st\u00e1tn\u00edch subjekt\u016f nebo ozbrojen\u00fdch sil, a&nbsp;to i&nbsp;prost\u0159ednictv\u00edm vlastnick\u00e9 struktury nebo v\u00fdznamn\u00e9ho financov\u00e1n\u00ed\u201d (Official Journal of the European Union L 79\/1 2019). Vym\u00e1h\u00e1n\u00ed kontroly zahrani\u010dn\u00edch investic je ale ponech\u00e1no \u010dlensk\u00fdm zem\u00edm a v \u0159ad\u011b p\u0159\u00edpad\u016f byla prov\u00e1d\u011bna nesystematicky (White &amp; Case LLP 2024; European Commission 2025d). Sou\u010dasn\u00fd n\u00e1vrh Evropsk\u00e9 komise by roz\u0161\u00ed\u0159il arzen\u00e1l obchodn\u00edch n\u00e1stroj\u016f EU, aby zabr\u00e1nil toku zbo\u017e\u00ed a kapit\u00e1lu do \u010c\u00edny t\u00edm, \u017ee by zlep\u0161il kontrolu p\u0159\u00edm\u00fdch zahrani\u010dn\u00edch investic, harmonizoval kontroly v\u00fdvoz\u016f zbo\u017e\u00ed s du\u00e1ln\u00edm vyu\u017eit\u00edm, identifikoval rizika u odchoz\u00edch investic a pos\u00edlil bezpe\u010dnost v\u00fdzkumu (European Commission 2024c).<\/p>\n\n\n\n<p>Evropsk\u00e1 unie zavedla \u0159adu regula\u010dn\u00edch n\u00e1stroj\u016f zam\u011b\u0159en\u00fdch na ochranu genetick\u00fdch \u00fadaj\u016f sv\u00fdch ob\u010dan\u016f a na prevenci jejich zneu\u017eit\u00ed. Mezi nejv\u00fdznamn\u011bj\u0161\u00ed pat\u0159\u00ed syst\u00e9m kontroly v\u00fdvozu zbo\u017e\u00ed s dvoj\u00edm u\u017eit\u00edm (Official Journal of the European Union L 206\/1 2021) a Obecn\u00e9 na\u0159\u00edzen\u00ed o ochran\u011b osobn\u00edch \u00fadaj\u016f \u2013 GDPR (European Union 2016). Tyto r\u00e1mce spole\u010dn\u011b vytv\u00e1\u0159ej\u00ed p\u0159\u00edsn\u00fd re\u017eim reguluj\u00edc\u00ed v\u00fdvoz genetick\u00fdch informac\u00ed mimo EU, zejm\u00e9na pokud existuje riziko jejich vyu\u017eit\u00ed pro vojensk\u00e9 \u00fa\u010dely, poru\u0161ov\u00e1n\u00ed lidsk\u00fdch pr\u00e1v nebo naru\u0161en\u00ed biologick\u00e9 bezpe\u010dnosti. &nbsp;Re\u017eim zbo\u017e\u00ed dvoj\u00edho u\u017eit\u00ed ukl\u00e1d\u00e1 povinnost z\u00edskat v\u00fdvozn\u00ed licenci v p\u0159\u00edpadech, kdy existuje podez\u0159en\u00ed, \u017ee by genetick\u00e1 data nebo s nimi spojen\u00e9 technologie mohly b\u00fdt vyu\u017eity k rozvoji biologick\u00fdch zbran\u00ed, \u0161pion\u00e1\u017ei nebo jin\u00fdm neetick\u00fdm \u010dinnostem. Aby bylo tohoto c\u00edle dosa\u017eeno, mus\u00ed b\u00fdt hlavn\u00ed pozornost v\u011bnov\u00e1na genomick\u00e9mu sekvenov\u00e1n\u00ed, kter\u00e9 p\u0159edstavuje jak vstupn\u00ed br\u00e1nu, tak potenci\u00e1ln\u00ed \u00fazk\u00e9 hrdlo pro dal\u0161\u00ed biotechnologick\u00fd rozvoj. Evropsk\u00e1 unie a jej\u00ed \u010dlensk\u00e9 st\u00e1ty si mus\u00ed uv\u011bdomit, \u017ee pouh\u00e1 snaha \u201eb\u011b\u017eet rychleji\u201c nebude dosta\u010duj\u00edc\u00ed, pokud se m\u00e1 p\u0159edej\u00edt opakov\u00e1n\u00ed sc\u00e9n\u00e1\u0159e zn\u00e1m\u00e9ho z oblasti 5G technologi\u00ed, kdy byla nutnost hled\u00e1n\u00ed alternativn\u00edch dodavatel\u016f vyvol\u00e1na bezpe\u010dnostn\u00edmi obavami ohledn\u011b \u010d\u00ednsk\u00e9ho vlivu. Biotechnologie a p\u0159edev\u0161\u00edm slu\u017eby spojen\u00e9 se sekvenov\u00e1n\u00edm DNA maj\u00ed strategick\u00fd v\u00fdznam, a jejich kontrola by nem\u011bla b\u00fdt ponech\u00e1na akt\u00e9r\u016fm, kte\u0159\u00ed nejsou ochotni dodr\u017eovat liber\u00e1ln\u011b-demokratick\u00e9 normy.<\/p>\n\n\n\n<p>K tomu, aby EU mohla hr\u00e1t aktivn\u00ed roli v t\u00e9to oblasti, je zapot\u0159eb\u00ed t\u0159\u00ed krok\u016f. Za prv\u00e9, je nutn\u00e9 si pln\u011b uv\u011bdomit rizika spojen\u00e1 s dynamikou biotechnologick\u00e9ho rozvoje v \u010c\u00edn\u011b, v\u010detn\u011b netransparentn\u00edch a netr\u017en\u00edch praktik.
